Process Serving in San Diego and Service of Process on Military Installations

At eServe San Diego we cover the entire County of San Diego, California. This means that we also have several different Military basis in our coverage area. Most of the basis we encounter process serving on are Camp Pendleton in North County San Diego, USMC in Central San Diego and the Naval Facilities in Central San Diego. Each location has its own established rules on process serving on base. For example the Marines in Camp Pendleton have an office that handles all matters relating to process serving on their base. Although often service does take time to arrange on Camp Pendleton it is almost always completed when serving an enlisted individual on Base. The exception to this rule is when an individual needs to be served on base, but is a civilian. Often spouses or family members of enlisted Marines live on base, but the legal office at Camp Pendleton cannot force them to accept service as they can with an enlisted individual.

Although the process on Camp Pendleton seems tedious and difficult it is actually the easiest Military Facility to work with in San Diego. When we have an individual in the Navy who lives on base we contact a legal office on the Navy base. We then follow a similar procedure for arranging for service, but unlike the Marines who force the enlisted individual to appear to get served the Navy generally gives them the option of whether or not they want to be served. They do not force the individual to accept service so often times the process can take some time and is not always successful. A further complication to this process is that often these individual may be on a ship that is on deployment and they cannot be served until they return to harbor in San Diego.  The schedule of these ships is not public information and the Navy’s legal office will not notify the process server when the ship returns to harbor so often we have to ask regularly if the individual has returned to harbor. This make this service difficult and sometimes nearly impossible to complete.

USMC Marine Base in San Diego see few services, but the couple we have had on that base have had mixed results. On several occasions service of process was arrange and eServe’s process servers were able to attain personal service. On one occasion though upon arranging for service and providing a copy of the documents, the individual we were attempting to server was pulled from basic training. He was separated from the group and sent home, to re-enlist once he had taken care of his open criminal case. We were not able to serve him as this was done quickly, but we were able to provide our client with a timeline of when he would return to his home State so that our client could arrange for service there.
